Is Medical Marijuana permitted in Federally-Assisted Housing?
No. The use of medical marijuana is not permitted in federally subsidized housing, despite state laws allowing its use in certain circumstances. The classification of marijuana as a Schedule 1 substance under the Controlled Substance Act makes possessing, distributing or manufacturing of marijuana a federal criminal offense.
On January, 20, 2011, HUD issued a Memorandum addressing this issue and reaffirming their position as stated in their initial memo of September 24, 1999 on this same topic.
